Guest Reservation and Rental Contract
Please read this rental agreement, enter the required information at the bottom of the form and return the form to us.
Contract at stated rate is based on the number of occupants listed herein. Condo Associations require all names listed on rental agreement. All vacation rentals are for quiet enjoyment of the registered guest. No additional people or functions are allowed without prior written approval of agent and/or owner. Additional charges and loss of rental may apply for violations/alterations of this contract.
No large functions are permitted at any of our vacation rentals.
Rates are quoted on a per night, per week or per month basis. Check in time is after 3:00 PM and check out is by 10:00AM on the day of departure. Three (3) night minimum stay and five (5) night minimum during holidays. Reservation less then two nights will be charged an additional fee. Should there be any additional guest not approved by agent in writing, additional charges will be charged to credit card on file. All rates subject to change without prior notice except for booked reservations that are paid.
Additional charges: (not included in nightly rate)
$30 booking fee, $45 damage protection insurance, 13.42% Hawaii tax and cleaning fee added to all rentals. Tax rate is subject to change. Rates do no include daily maid service, long distance telephone charges. We charge additional for trip insurance, trash removal, missing items, moving furniture, additional guests, excess cleaning dishes and laundry. Local calls and internet if available are free.
Guests agree to indemnify and hold harmless Owner, Molokai Vacation Properties (Agent) from any and all claims, liabilities, and damages arising out of or related to guests' use of the Property by guest, guests’ family, invitees, employees or any other persons using the property with guests' consent during the rental period. Owner shall not be liable for any loss of or damage to guests' possessions at the Property during the rental period.
Reservation and Payments:
Payment in full is due at time of reservation. No grace period will apply. You can pay by check along with credit card to hold the reservation. Checks are made payable to: Molokai Vacation Properties.
Cancellation and Refunds:
Cancellation of a reservation 30 or more prior to arrival will result in a $200 cancellation fee retained by Molokai Vacation Properties. Cancellation within 30 days of arrival will result in 100% loss of payment. To protect against cancellations caused by certain unforeseen events such as illness, we recommend that guests purchase travel insurance to protect their trip investment, please contact us to add travel insurance to your booking. Conditions of Rental:
The property shall be left in the same condition upon departure as at check-in. Normal wear and tear accepted. We will charge for any furniture that has been moved and needs to be put back. Owner and its agents may enter the property at reasonable time to make repairs or inspections if needed.
Guests may cook only in areas specifically designated for cooking. Guests must immediately notify owner or its agent of fire or other damages to the property.
Guests shall be liable for all acts of guests, guest’s family, invites, employees, or other person invited onto the property during guest's stay. Guests may not sublet or assign this rental agreement. Guests shall be responsible to return all keys upon departure to lock box. $25 charge for house keys and $50 for pool keys lost. Guests shall abide by the House Rules of the Condo Association. Guests shall not bring any pets onto the property that are not "service animals". Service papers must be provided to Association manager.
Guests understand that there are certain risks inherent to persons and property located adjacent to the ocean and acknowledge that the Owner would not rent this property unless this condition were accepted by the guests.
No smoking in the vacation rental or anywhere on property of a Condo Association. Any violation of this policy will incur a $150.00 charge.. Should unit booked by guest become unavailable due to sale or unforeseen circumstances, Molokai Vacation Properties will attempt to relocate your reservation to a comparable property or refund you.
Damage & Security Deposit:
Property Protection Program. Our properties and their contents are valuable
and reasonable care should be taken with them during their rental. Our
company, including the participating rental property homeowners we
represent ("we", "our", "us"), is an additionally-insured participant in a
Property Protection Program that reimburses certain costs for unintentional
accidental damage to our properties during their rental occupancy. With our
participation in this Program, except in certain circumstances, we may not
collect and hold refundable pet, damage, or security deposits. We charge
renters a non-refundable administrative fee to defer our costs for Program
participation. If, during a renter's occupancy, the renter or a member of
renter’s party or renter’s guest causes any damage to real or personal
property of our rental property as a result of unintentional accidental acts or
omissions, the renter must notify our property management office at that
time, and before check-out. For rentals that exceed the coverage limits of
the Program, we may collect a supplementary refundable (net of any
damage reimbursement) security deposit from renter upon check-in. Renter
is liable to us for any damages caused by the renter or a member of renter's
party or renter's guest that are not reimbursed to us or exceed the
maximum per-incident limit of our coverage, and the credit card on file
and/or any collected security deposit will be charged. If the renter wishes to
pay a refundable (net of any damage reimbursement) damage security
deposit, renter must notify us before check-in. Special or large event
and/or pet deposits may be charged in certain situations.
I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by Owner's restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named on the guest list herein.
This is the entire Agreement between the parties and shall be governed by the laws of the State of Hawaii and the USA.
